1. Acceptance of Terms

By accessing or using the Rituala website, mobile application, or any services provided by Rituala, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our services.

We reserve the right to modify these Terms at any time. Continued use of our services after any changes constitutes acceptance of the new Terms. We will notify you of material changes via email or through the Service.

2. Description of Service

Rituala provides an AI-powered trichology and hair care advisory platform that offers:

• Personalized hair care routine recommendations
• AI-generated hair and scalp analysis
• Product recommendations and suggestions
• Educational content about hair care
• Progress tracking and analytics

3. Important Disclaimer: Not Medical Advice

You acknowledge and agree that:

• All advice, recommendations, and content provided through our Service are generated by artificial intelligence and are for informational purposes only.
• You should always seek the advice of a qualified healthcare provider with any questions regarding a medical condition, including hair loss, scalp conditions, or other health concerns.
• Never disregard professional medical advice or delay seeking it because of information provided through Rituala.
• We do not guarantee any specific results from following our recommendations.
• Individual results may vary significantly based on genetics, health conditions, product usage, and other factors beyond our control.

4. Eligibility and Account Registration

To use certain features of our Service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Accept responsibility for all activities under your account.
• Notify us immediately of any unauthorized use of your account.

Age Requirements: Rituala is intended for adults aged 18 and over. You must be at least 18 to use the Service. AI features require a separate confirmation of age and permission to share relevant information with Google Gemini.

5. Subscription and Payment Terms

Rituala offers both free and paid subscription services:

• Free Tier: Limited access to basic features, including the initial hair quiz and basic recommendations.
• Journey Subscription: Additional routine, progress, and Ask AI features, subject to the limits and benefits shown before purchase.

For paid subscriptions:

• You authorize us to charge your payment method on a recurring basis until you cancel.
• Subscription fees are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by law or as explicitly stated in these Terms.
• Price changes follow the notice and consent requirements of the store or payment provider where you subscribed.
• You can cancel through the provider where you subscribed. For iOS subscriptions, use your App Store account subscription settings. Access ordinarily continues until the paid period ends. Deleting a Rituala account does not cancel an Apple subscription.

6. User Content and Data

You may submit content to our Service, including but not limited to photos, hair profiles, reviews, and feedback ("User Content"). By submitting User Content, you:

• Grant us a non-exclusive license to store and process your content only as needed to provide the features you request, operate the Service, and meet legal obligations.
• Represent that you own or have the rights needed to submit that content.
• Keep ownership of your content. This license does not authorize selling your personal content, unrelated advertising, or training Rituala's own models. Optional AI sharing is described separately below and in our Privacy Policy.

7. Data use and AI permission

We process personal information as described in our Privacy Policy. We do not sell personal information or share it for cross-company advertising. Personalized AI features send relevant profile, routine, and message context to Google Gemini only after explicit permission. You can decline or withdraw that permission in Privacy Settings. Rituala does not use your personal content to train its own AI models.

8. Intellectual Property Rights

All content, features, and functionality of our Service (including but not limited to text, graphics, logos, icons, images, audio clips, software, AI models, algorithms, and compilations) are owned by Rituala, Inc. or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without written permission.
• Use our trademarks or branding without authorization.
• Reverse engineer, decompile, or attempt to extract our AI algorithms or source code.
• Use automated systems or software to extract data from our Service ("scraping").

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Impersonate any person or entity or misrepresent your affiliation.
• Upload content that is harmful, offensive, defamatory, or infringes on others' rights.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with or disrupt the Service or servers.
• Use the Service to transmit malware, spam, or other harmful content.
• Resell, redistribute, or commercially exploit our Service without authorization.

10. Third-Party Products and Links

Our Service may recommend or link to third-party products, services, or websites. We do not endorse, warrant, or guarantee any third-party products or services. Your interactions with third parties are solely between you and the third party. We are not responsible for:

• The quality, safety, or effectiveness of recommended products.
• Any allergic reactions, adverse effects, or damages from using recommended products.
• Third-party websites' content, privacy practices, or terms.
• Any transactions or disputes with third parties.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Service will be uninterrupted, error-free, secure, or virus-free.
• Warranties regarding the accuracy, reliability, or completeness of any content or recommendations.
• Warranties that results from the Service will meet your expectations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RITUALA, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of profits, revenue, data, goodwill, or other intangible losses.
• Any damages arising from your use or inability to use the Service.
• Any damages arising from recommendations, advice, or content provided through the Service.
• Any damages arising from unauthorized access to or alteration of your data.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Rituala, Inc. and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of another party.
• Your User Content.

14. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, USA, or another mutually agreed location. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, then the entirety of this arbitration provision shall be null and void.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@tryrituala.com within 30 days of first accepting these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For users outside the United States, you agree that the laws of Delaware will govern these Terms and any disputes.

16. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease.
• We may delete your account and data (subject to our data retention policies and legal obligations).
• Provisions that by their nature should survive termination will survive (including ownership, warranty disclaimers, indemnity, and limitations of liability).

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Rituala, Inc. regarding your use of the Service and supersede any prior agreements.
