You acknowledge and agree that:

Rituala offers both free and paid subscription services:

• Free Tier: Limited access to basic features, including the initial hair quiz and basic recommendations.
• Premium Subscription: Full access to all features, including unlimited AI consultations, detailed analytics, and personalized product recommendations.

For paid subscriptions:

• You authorize us to charge your payment method on a recurring basis until you cancel.
• Subscription fees are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by law or as explicitly stated in these Terms.
• We may change subscription fees upon 30 days' notice. Continued use after the price change constitutes acceptance.
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

6. User Content and Data

You may submit content to our Service, including but not limited to photos, hair profiles, reviews, and feedback ("User Content"). By submitting User Content, you:

• Grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media or distribution methods now known or later developed.
• Represent that you own or have the necessary rights to grant this license.
• Waive any moral rights in your User Content to the extent permitted by law.

• Any loss of profits, revenue, data, goodwill, or other intangible losses.

• Any damages arising from recommendations, advice, or content provided through the Service.
• Any damages arising from unauthorized access to or alteration of your data.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Rituala, Inc. and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of another party.
• Your User Content.

14. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, USA, or another mutually agreed location. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, then the entirety of this arbitration provision shall be null and void.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@tryrituala.com within 30 days of first accepting these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For users outside the United States, you agree that the laws of Delaware will govern these Terms and any disputes.

16. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease.
• We may delete your account and data (subject to our data retention policies and legal obligations).
• Provisions that by their nature should survive termination will survive (including ownership, warranty disclaimers, indemnity, and limitations of liability).

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Rituala, Inc. regarding your use of the Service and supersede any prior agreements.
